Terms of Service

These terms are an agreement between you and Go Fish Originators Inc. ("we", "us"), which provides the .MD Brain desktop app, Web Admin, and cloud service (together, ".MD Brain"). By creating an account, starting a trial, or paying for a plan, you agree to these terms and to our Refund & Cancellation Policy.

1. Your account

• Give us a valid email address and keep your password private. You are responsible for activity on your account.
• An account can be connected to one computer at a time. You can sign a computer out from the desktop app or from Web Admin.
• You must be old enough to form a binding contract where you live.

2. Free trial

• After you verify your email, you get a 30-day free trial of Level III. The subscription fee is free during the trial. No card is needed to start.
• AI usage is not included in the trial. To use AI features you fill your own AI limit (minimum US$5), which is charged to your saved payment method. Trial AI funding is used up during the trial and does not carry over; the monthly AI limit is charged again when Level III starts.
• One trial per person and per computer.
• Level I is free forever. When the trial ends, your account moves to Level I unless you have chosen Level II or III and saved a payment method. If you have, your first month is charged when the trial ends.

3. Plans and prices

• Level I — Auto-Clean: free forever
• Level II — Go-Back: US$10 per month
• Level III — AI + Deep Mind: US$20 per month, plus the monthly AI limit you choose (minimum US$5)

• Prices are in US dollars. Charges appear as Go Fish Originators Inc.
• Plans are billed monthly in advance on your billing date and renew automatically until you cancel.
• Upgrades start right away and charge the difference for the rest of the current month (moving to Level III also charges your monthly AI limit). Downgrades start on your next billing date.
• At Level III, raising your monthly AI limit charges the increase right away. When the limit is used up, AI features pause until you raise it or the next month starts; everything else keeps working.
• We may change prices with at least 30 days' notice by email. New prices apply from your next billing date after the notice period.

4. Payment and failed payments

• Your card or PayPal account is saved securely by PayPal. We never see or store your full card number.
• If a charge fails, paid features stop until the payment succeeds. You can pay or change your payment method any time in Billing & Plan, and service returns right away.

5. Cancelling, pausing, and refunds

You can cancel or pause any time in Billing & Plan. How that works, and when we refund, is in our Refund & Cancellation Policy.

6. Your data and your files

• Your .md files and the content in them are yours. .MD Brain works on them on your behalf.
• We store what the service needs to run (for example synced chats, backups, and settings) and protect it as described in our security practices. We do not sell your data.
• AI features send the relevant content to our AI provider (OpenAI, through its business API) to produce results. Content sent through that API is not used to train its models.
• After service stops, we keep your data for 180 days, then it may be deleted. You can ask us to delete it sooner.

7. AI results

AI output can be wrong or incomplete. Review AI-written summaries, deposits, and file updates before you rely on them. .MD Brain keeps version history so you can go back.

8. Acceptable use

Do not use .MD Brain to break the law, to infringe others' rights, to attack or overload our systems, to get around plan limits, or to share one account between different people.

9. Changes and availability

• We improve .MD Brain over time and may change or remove features. If a change materially reduces what your level includes, we will tell you first.
• We aim to keep the service available but cannot promise it will never be interrupted.
• If we change these terms, the new version gets a new date. You will be asked to accept it the next time you sign in to Web Admin.

10. Suspension and ending

We may stop service on an account that breaks these terms or has an open payment dispute. You can stop using .MD Brain at any time by cancelling.

11. Disclaimers and liability

.MD Brain is provided "as is". Keep your own backups of important files. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

12. Indemnification

You will defend, indemnify, and hold harmless Go Fish Originators Inc. and its officers, directors, employees, and agents from and against any claim, demand, loss, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to:

• your use of .MD Brain, or anyone's use of your account;
• content you submit, sync, or store, including your chats, .md files, and instructions to the AI features;
• your breach of these terms, or your violation of any law or of someone else's rights.

We will give you prompt notice of a claim we expect you to cover (except where delay does not materially harm you), and you will not settle a claim in a way that admits fault by us or imposes an obligation on us without our written consent. This section survives the end of your account.
